Please read these terms before you use the app. Downloading or using Tropicaleze Radio means they apply to you.
Tropicaleze Radio is published by G & D Enterprises Inc. In these terms, “we”, “us” and “our” mean G & D Enterprises Inc and its partners, and “the app” means the Tropicaleze Radio mobile application. “You” means the person using it.
Your license to use the app
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, for your own listening.
That license does not let you do any of the following:
- Copy the app, or any part of it, other than the ordinary copy your device makes to run it
- Modify the app or create derivative versions of it
- Reverse engineer, decompile, disassemble, or otherwise attempt to extract the source code
- Translate the app into other languages
- Rent, lease, lend, sell, sublicense, or otherwise distribute the app
- Remove or obscure any copyright, trademark, or other proprietary notice
- Use our trademarks, name, or branding without our written permission
If you want to do any of these, ask us. Some of it we may be happy to agree to.
Ownership
The app and everything in it remain ours. That includes the software, the design, the artwork, the Tropicaleze name and logo, and all trademarks, copyright, database rights, and other intellectual property rights connected to it. Those rights belong to Tropicaleze.com and its partners, including G & D Enterprises Inc.
Nothing in these terms transfers any of those rights to you.
The audio you hear through the app, including music, recordings, and programming, belongs to its own rights holders. Streaming it through the app does not give you any right to record, copy, redistribute, rebroadcast, or publicly perform it.
Changes to the app
We want the app to be as useful and as efficient as we can make it. That means we may change it, add to it, or remove parts of it at any time and for any reason. We may also stop offering it altogether.
The app is free today. We reserve the right to charge for the app or for particular features in the future. If we ever do, we will make it entirely clear what you are paying for before you pay anything. We will not charge you for something you already have without telling you first.
Availability, and what we do not promise
The app is provided as is and as available. We do not guarantee that it will always work, that it will work on every device, or that the stream will be uninterrupted or error free.
Plenty of things outside our control can stop it working. Your internet connection may drop. Your mobile carrier may throttle streaming. Your device manufacturer may shut the app down in the background to save battery. Google Play or your operating system may change in ways we have not caught up with yet. Our streaming provider may go down. Any of these can interrupt playback, and none of them are within our power to fix on your behalf.
To the fullest extent the law allows, we exclude all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
About the alarm feature
Please read this part properly, because it matters more than the rest.
The app includes a wake alarm. It is offered as a convenience and it is not a reliable alarm clock.
Android actively restricts what applications may do while your phone is idle, and manufacturers such as Samsung, Xiaomi, Huawei, and OnePlus add further restrictions on top. Depending on your device, your settings, your battery level, and your operating system version, a scheduled alarm may ring late or may not ring at all. The app includes a setup guide explaining how to reduce that risk, but we cannot eliminate it.
Do not rely on this alarm for anything that matters. Use a dedicated alarm clock as well for work, travel, medication, or any other commitment where missing the time would cause you loss, injury, or harm. We accept no responsibility for a missed alarm or for anything that follows from one.
The same applies to the sleep timer. It is a convenience feature, not a guarantee that playback will stop.
Your use of the app
The app is intended for listeners who want to listen to Tropicaleze Radio. That is what it is for.
You agree not to use the app to break the law, to interfere with or disrupt the service or the servers behind it, to attempt to gain unauthorized access to any part of it, or to capture, record, or redistribute the stream.
How you use the app is your responsibility. Neither Tropicaleze nor G & D Enterprises Inc takes responsibility for the way you choose to use it, or for anything you do as a result of using it.
Data
The app does not require you to create an account and does not ask for your name, your email address, or your phone number in order to listen. It shows no advertisements.
A small amount of technical information does leave your device: our notification provider receives a device token and basic device details so push notifications can reach you, and our streaming provider receives your IP address whenever audio is playing, as it must in order to send you audio. Our Privacy Policy sets out exactly what that involves and how to switch notifications off.
We do not sell your information, and we do not share it beyond the service providers named in the Privacy Policy.
Third party services and links
The app relies on services operated by other companies, including Google Play, our notification provider, and our streaming provider. Their terms and their privacy policies apply to their part of the arrangement, and we do not control them.
The app can open our website and our social media pages. Once you follow a link out of the app, you are on somebody else’s service and these terms no longer govern what happens there.
Notifications
If you allow notifications, we may send you messages about programming, station announcements, and app updates. You can turn them off at any time in your device settings without losing access to anything else in the app.
Updates and support
We may release updates to the app. Some updates may be required in order to keep using it. Your device settings control whether updates install automatically.
We may stop supporting older versions of the app or older operating system versions at any time.
Limitation of liability
To the fullest extent permitted by law, neither G & D Enterprises Inc nor its partners, directors, employees, or suppliers will be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or connected with your use of the app or your inability to use it. This applies however that liability arises, and whether or not we were warned that such loss was possible.
Where liability cannot lawfully be excluded, our total liability to you is limited to the amount you have paid us for the app, which for the free version is nothing.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
Ending your use
You can stop using the app at any time by uninstalling it.
We may suspend or end your license to use the app if you breach these terms. On termination, the rights granted to you stop and you must remove the app from your devices.
Governing law
These terms are governed by the laws of the state of Delaware in the United States where G & D Enterprises Inc is incorporated, without regard to conflict of law principles. Any dispute will be brought in the courts of that jurisdiction. If you are a consumer, this does not remove any protection you have under the mandatory law of the country you live in.
Changes to these terms
We may update these Terms and Conditions from time to time. You are advised to review this page periodically. We will notify you of changes by posting the revised version here, and changes take effect once posted. Continuing to use the app after that means you accept them.
